Registrar's Limited Jurisdiction: Membership Disputes Involving Inheritance and Transfer Validity Under the Maharashtra Cooperative Societies Act, 1960.
Court: Bombay High Court
Citation: 2025:BHC-AS:55165
Decision Date: 16-12-2025
List of Laws
Article 226 of the Constitution of India; Maharashtra Cooperative Societies Act, 1960; Section 11 of the Maharashtra Cooperative Societies Act, 1960; Section 22 of the Maharashtra Cooperative Societies Act, 1960; Section 25A of the Maharashtra Cooperative Societies Act, 1960
- Facts: The petitioner, Namdeo Suratsingh Chaudhary, challenged an order directing the entry of Respondent No. 1's name (Natu Ambersingh Patil, through legal heirs) as a member of Bijlee Cooperative Housing Society Ltd. in place of the petitioner. Respondent No. 1 claimed to be the legal heir of the original member, Natu Patil, and alleged that the petitioner's membership was obtained through collusion and an illegal transfer. The petitioner contended that Natu Patil had transferred his membership in 1976 and never disputed it.
- Procedural Posture: The petitioner invoked Article 226 of the Constitution, challenging the order of the Divisional Joint Registrar, which confirmed the Assistant Registrar's order directing the society to enter Respondent No. 1's name in place of the petitioner. The petitioner had initially challenged the Assistant Registrar's order by filing a revision, which was unsuccessful.
- Issue: Does the Registrar, under Sections 11, 22, and 25A of the Maharashtra Cooperative Societies Act, 1960, have the jurisdiction to remove the petitioner's name and enter Respondent No. 1's name in the society's records based on a dispute over inheritance and the validity of a transfer that occurred decades prior?
- Holding: No, the Registrar does not have the jurisdiction to decide such a dispute.
- Reasoning: The Court reasoned that Section 11 of the Maharashtra Cooperative Societies Act confers a narrow jurisdiction on the Registrar, limited to deciding preliminary questions regarding basic membership qualifications such as whether a person is an agriculturist or resides within the society's area of operation. It does not extend to adjudicating complex disputes involving succession, challenges to transfers, validity of documents, or allegations of forgery. The Court emphasized that Section 25A only allows for the removal of a member's name if they have ceased to be a member or are disqualified under the Act, and does not authorize the Registrar to decide disputed questions of title or declare a past transfer invalid. The Court found that Respondent No. 1's grievance pertained to succession and the alleged misuse of authority in 1976, matters that fall outside the Registrar's limited jurisdiction. The Court stated, "Section 11 is meant for deciding only a narrow set of questions... It is not designed to handle complicated disputes. It is not meant for deciding whether a membership was legally transferred many years ago. It is not meant for deciding who inherited rights after a member's death." The Court allowed the petition in part, setting aside the order affirming the substitution of Respondent No. 1 in the membership register.
